Experience of municipal police of the Czech Republic – application in Russia


After publication of article about municipal police of the Czech Republic and discussion in group, many subscribers paid attention to one interesting moment in its activity. It is about one distinctive feature of the legislation of the Czech Republic on municipal bodies of protection of law and order. Namely – according to the law on municipal police in the Czech Republic, municipalities which did not found the police can conclude agreements with those municipalities which in which are municipal police about distribution on their territory of powers of municipal police of other (usually neighboring) municipal district.
In other words, they can create intermunicipal divisions of municipal police which are in one (usually the largest) the city, but services such division also the next municipalities. It becomes on the basis of the agreements concluded between administrations of these settlements. Financing of such division is also carried out in common.
Similar intermunicipal departments exist in the Ministry of Internal Affairs of the Russian Federation, so, the similar structure can quite be applied also in municipal police, on condition of proximity. For example, when several large city settlements of the area are located in a radius of 10-15 kilometers from the regional center.
It is made first of all of economic reasons. It is no secret that the maintenance of intermunicipal divisions costs cheaper. It is connected with the fact that they have one governing body serving a little nearby the located settlements.
That, it was more clear - if each municipality creates the department (or office) municipal police, then it it is necessary to create it as full-fledged division, namely to allocate the certain room equipped according to requirements, to create conditions for storage of weapons, property, transport. To appoint the head, deputies, a position of providing and service, the headquarters and a control room. All this costs considerable money and not each municipal budget will master such expenses.
For an example – the large city we will conditionally call it «А», has department of municipal police as a part of administration, near this city there are two more cities (or settlements) will call them «B» and less «C».
In the city «А» the number of department is 98 employees as approximately it looks it is possible to look in this article. From these 98 established posts - 23 treat to the management, to providing and the headquarters and 75 units are a company of security guard and patrol service.
If the cities of «B» and «C» which it is twice less on the area and the population need to create the municipal police, then for each of them the number of staff of divisions will look as follows: in total employees – 58, from them:
- the management, providing and the headquarters – 20 units;
- a platoon of security guard and patrol service – 38 units.

Total on all three cities the following picture turns out:
in total on the state – 214 employees, from them:
- the management, providing and the headquarters – 63 units;
- security guard and patrol service – 152 units.
The share of the employees belonging to the management, the headquarters to providing and service makes nearly 30% of total number. It is too much and expensively.

But if to unite these three separate divisions in one intermunicipal department, then a picture it will be perfect other:
in total on the state – 180 employees, from them:
- the management, providing and the headquarters – will make 28 units;
- security guard and patrol service – 152 units.
As a result 34 excess administrative units are released, and the number of employees of security guard and patrol service remains the same.
If to add to it also lack of need for allocation of additional rooms and the related expenses, then even taking into account increase in expenses on fuel and service of office motor transport, cumulative economy will make from 20 to 30%.
It is very essential sum, but the main thing that at such approach the number of police officers on streets does not decrease.
It is unconditional that the similar scheme of the organization of territorial divisions of municipal police quite is suitable for our country and similar experience should be adopted. It will allow to increase efficiency of use of forces and means of municipal (local) police and to considerably reduce costs of its contents.
In addition, It should be noted that federal and regional (area, edge, the district) the authorities allocate subsidies and grants for implementation of those projects and programs which implementation cover several municipal units at once much more willingly.
Proceeding from the above arguments the decision to prepare addition in the draft federal law «About Municipal Police in the Russian Federation» was made. The amendment purpose - to grant to local governments of municipal units the right to conclude agreements on creation of intermunicipal divisions of local police which will serve the territory of several municipal units.
For this purpose Article 4 of the draft federal law «About Municipal Police in the Russian Federation» was supplemented with Part 6 of the following contents:
- 6. The local governments of municipal units incorporating division of municipal police can conclude agreements with local governments of other municipal units on distribution on their territory of powers of municipal police. Provided that the municipal units which concluded this agreement have the general border.
It is preliminary edition which will perhaps undergo some changes, technical character connected with the correct statement of the text in the nearest future. It is also possible that its text will be expanded several subparagraphs containing a number of the general requirements to such agreements, or sending on the separate statutory act establishing these requirements.
In addition, in plans in more detail to consider how similar practice works not only in the Czech Republic, but also in other countries, for some sources something similar exists in Canada.
